Welcome to the last legal content update for 2024! This month’s edition includes more updates in the Personal Injury space, as well as improvements to the Mortgage (VIC) matter type and existing Smokeball reports as well as forms updates.

Personal Injury - Victims of Crime (VIC)

Commencing Monday, 18 November the Victims of Crime Assistance Tribunal (VOCAT) was replaced by the new Financial Assistance Scheme (FAS). Pending applications in the VOCAT will remain there but all new applications are to be in the FAS, with VOCAT remaining until all pending applications are completed.

As a result we have added the following new FAS forms to the Precedent library:

  • FAS Client Authorisation Form

  • FAS Medical and/or mental health report template

  • FAS Medical Letter Template

  • FAS Mental Health Letter Template

  • FAS Statutory Declaration Template for Authorised Representative - Police Reporting

  • FAS Statutory Declaration Template for Authorised Representative - Miscellaneous

  • FAS Support or Social Worker Letter Template

  • Adult - FAS Cultural Support Plan Template

  • Child & Young Person - FAS Cultural Support Plan Template

  • VOCAT Variation Application Form

  • FAS Statutory Declaration Template - Parent or Guardian or Administrator appointing an Authorised Representative

  • Financial Assistance Scheme Guidelines

  • FAS Cultural Safety Commitment Statement

Additional Personal Injury Lead Types

This month we also added the following new Personal Injury Lead Types:

  • ‘Comcare’ Lead Type (all States);
  • ‘COVID-19 Vaccine Claims Scheme’ Lead Type for VIC; and
  • ‘Institutional Abuse’ Lead Type for VIC and SA.

Mortgage (VIC) Update

The Loan Details layout in the Mortgage (VIC) Matter Type has been updated with the following additional fields added:

  • Loan Type, Loan to Value Ratio, Classification (NCCP/Non-NCCP);
  • Mortgage details (Priority/MCP Number);
  • Interest Details (Fixed Rate, Lower Rate, Higher Rate);
  • Repayment Details (Final Repayment Date, Fixed, Higher and Lower Repayment Amounts and Number of Repayments);
  • Lender Fees, Lenders Mortgage Insurance, and Other Costs;
  • Loan Conditions (new tab);
  • The Property Details layout has also been updated to include the Nature of Property.

New ASIC Forms

Following client feedback, this month we also added the following forms which can be found in the ASIC Forms folder in the Precedent Library:

  • Form 960 - Application for a copy of a certificate

  • Form 407 - Notification of cessation, winding up or dissolution of a foreign company or registered Australian body

  • Form 410 - Application for reservation of a name

  • Form 362 - Notification by a company to nominate or cease a registered agent or contact address

  • Form 6010 - Application for Voluntary Deregistration of a Company

  • Form 5133 - Notification of Resignation, Removal, or Cessation of a registered scheme auditor

  • Form 492 - Request for Correction

  • Form 106 - Request to withdraw a lodged document

  • Form 962 - Application for information from an ASIC register

  • Form 5011 - Copy Minutes of Meeting

 

Report Improvements

The Client - Full List report in Smokeball has been updated to include a "Group by Client" option, as well as a new feature that links matter numbers to their corresponding matters in Smokeball. This allows you to click on a matter number and be directed to the related matter in Smokeball.
